Terms and Conditions
Please note that as a natural product leather does vary in colour from hide to hide and samples sent should
be considered a guide only. Colour variation is not considered a manufacturing fault. As leather is a unique
and natural material, the imperfections you may see due to healed scars, barbwire knicks, and other natural blemishes are simply characteristics of genuine leather.
1. Terms and Conditions of Trading: The Chesterfield Company
1.1. Product Specifications.
1.1.1 We have a policy of continuous product development and reserve the right to amend the specification of
products without prior notice in relation to future sales.
1.1.2 Goods supplied may differ as a consequence from those on display or advertised. Unless agreed with you,
the goods supplied will be of equivalent value, functionality and appearance. Any significant variations will be
highlighted on the display model.
1.1.3 Leather goods are made from quality natural leather and accordingly they may not be uniform in colour or
texture. Only the finest hides are selected but they will show natural marks and scars on the hide. Some leathers
will mellow with age and with exposure to sunlight and heat.
1.1.4 We will endeavour to match the colour and texture of the fabric of your sofa to the samples chosen as
accurately as possible, but variations in both the colour and texture may occur.
1.2.Measurements:
The measurements of all furniture and furnishings made by us will be as accurate as possible, but are
nevertheless approximate and subject to manufacturing tolerances up to and including +/- 7% of the total size.
1.3. Prices
All prices include VAT, where appropriate, at the prevailing rate and are subject to any promotional offer or
discount. Although every effort has been made to ensure that the prices displayed on this website are accurate
we reserve the right not to accept orders placed where the pricing is incorrect. in the unlikely event that this
situation should occur we will inform you prior to any goods being produced.
1.4. Payments
1.4.1 We require payment in full before dispatch of goods.
1.4.2 We will contact you as soon as possible to advise you of your estimated delivery date and at this time the
balance of any monies due will be payable.
1.5. Delivery
1.5.1 For all purchases we will contact you to arrange a delivery when your furniture is completed.
1.5.2 We will deliver your goods to any UK mainland address (excluding Northern Ireland). Please note that there
may be a surcharge for delivery to the Highlands (IV postcodes and above).
1.5.3 If we accidentally damage goods in the course of delivery, then our liability for that damage is limited to the
repair, refund or replacement of the goods or the value thereof.
1.5.4 Time of delivery is not of the essence in these Terms and Conditions of Trading. We will not be liable for
any direct or indirect loss of profits or other financial loss or damage suffered by you through any reasonable
delay or delay due to unforeseen circumstances outside of the reasonable control of The Chesterfield Company
or delay due to any reasonable rescheduling of delivery.
Please note that our export deliveries are usually kerbside only and subject to access by a 40ft trailer. In the unlikely event of any damage or omissions this must be written on the signed delivery note or your claim will be rejected.
1.6. Returns and Refunds
We will accept the cancellation of an order subject to the following conditions:
1.6.1. the Goods must not have been made to your specification or otherwise personalised to your requirements
and your order was not placed following a showroom visit.
1.6.2. If you wish to cancel the order, and have not seen the Goods in our showroom before placing your order,
you must notify us of your wish to cancel no later than 7 days after delivery, by email at
contact@thechesterfieldcompany.com or by letter delivered to our showroom by recorded delivery.
1.6.5 The Goods must have been delivered to an address within the United Kingdom.
1.6.6 If these conditions are satisfied, we will refund the price of the Goods and the refund will be paid to you
within 30 days of the date of cancellation. Your refund will be less £215 per suite (up to 4 seats) to cover the
transport costs. (U.K. Mainland deliveries only)
1.6.7 If you cancel, you are obliged to take reasonable care of any Goods delivered to you, which must be kept in
a never been used condition.
1.6.8 We aim to credit any monies arising from returns to your bank account within 30 days.
1.6.9. In the unlikely event of a manufacturing fault or transit damage, all faults will be repaired in situ wherever
possible, otherwise we will collect for factory repair; if beyond repair we will offer a replacement free of charge. If
you wish to return the item this will incur the standard return delivery charge.
1.6.10. If you wish to return an item for any reason this will incur a return delivery charge. This will be deducted
from any monies due to be credited to you. This includes items returned because they did not fit in your home. A
stool incurs a £60 transport charge; a chair or sofa up to 4str size, incurs a £215 transport charge. (UK Mainland
Deliveries only) Export deliveries are likely to incur a larger charge.
1.6.11. We offer a 7-day cancellation/returns policy. (The 7 days start on the date of order). Money will be
refunded in full during this period. Cancellation outside of this period will incur a £100 fee.
1.7. Payment:-
1.7.1. We can accept payment by Credit/Debit card, Cheque, Cash or Bank Transfer. Our prices listed online
include VAT and delivery to mainland U.K. Payments made by credit cards will incur a 2% fee. Our bank details for
payment by BACS are as follows:

1.7.2. Payment terms are 50% deposit when placing an order. The balance must be paid prior to delivery.
1.7.3. Please note that our cancellations/returns policy does not apply to bespoke items, this includes items
ordered in a colour not offered in the standard swatch listed online. (Your statutory rights are not affected).
1.8. Guarantees
1.8.1. The provisions of this clause apply in addition to your statutory consumer rights in relation to faulty or
misdescribed goods. These rights are not affected by the guarantee
1.8.2 For the purpose of this clause 7 the guarantor is The Chesterfield Company, registered address: Newbury
House, Ford Lane, Salford, M6 6PD
1.8.3 All furniture carries a 5-year guarantee against faulty workmanship and/or faulty materials in relation to
framework. All leather and fabric cover is guaranteed for 1 year.
1.8.4 Guarantees may not be transferred.
1.8.5 These guarantees do not cover fair wear and tear, neglect, abuse or misuse of your goods, loss or damage
(including rusting and corrosion) due to unreasonable exposure to water or weather; loss or damage due to fire,
smoke, explosion, lightning, sunlight, infestation by animals or boring insects, or theft, or accidental damage or
loss caused by a third party.
1.9. Claims Under Guarantee
1.9.1 In the event of a claim under guarantee occurring, please contact The Chesterfield Company
1.9.2 We will endeavour to repair the defective goods free of charge. If a repair is not possible you will be offered
a replacement and only if a suitable replacement is not available will you be offered a refund.
1.9.3 We will not be liable for any direct or indirect loss of profits or other financial loss or damage arising out of
defective, damaged or wrongly delivered goods, over and above the value of the goods themselves. This does
not affect your statutory rights.
1.9.4 Our guarantees are limited to goods sold and retained in the United Kingdom, and used solely for private
and domestic purposes.
1.10. Internet/Web Purchases
The following terms and conditions in this clause 10, apply only to purchases made through the Internet/Web
1.10.1 All our modular sofas from are made to your exact specifications and therefore cannot be cancelled once
we have accepted your order
1.10.2 In respect of all other purchases you have the right to cancel your order up to 7 days after the delivery
date. You must keep the product in a saleable condition and retain the original packaging in the condition it was
provided.

1.10.5 The following clauses apply to our Internet Site and Internet/Web orders only:
1.10.5.1 We endeavour to display as accurately as possible the colours of our products that appear on the
website. However we cannot guarantee that your monitor will accurately reflect the colour of the product
delivered.
1.10.5.2 The contract shall not be concluded until we have received your valid credit card charge or debit card
payment details and we have accepted your order.
1.10.5.3. Every effort is made to ensure the complete accuracy of our website however some prices/details may
change from time to time and it is possible that error may occur. We will use our best endeavours to rectify any
errors as swiftly as possible but we cannot be responsible for any losses incurred.
1.10.5.4. We are entitled to refuse any order placed by you.
1.10.5.5. To the maximum extent permissible by law, we exclude all warranties, expressed or implied as to the
accuracy of the information contained in any of the materials on the website. We cannot accept any liability for
any particular material on the website or as a result of any use or reliance placed upon information contained on
the website.
1.10.5.6. Any material downloaded or otherwise obtained through the use of this website is done at your own
discretion and risk. You will be solely responsible for any damage to your own computer systems or loss of data
that results from the download of such materials.
1.10.5.7. We control and operate the web site from our offices within England. Accordingly the laws of England &
Wales govern claims relating to, including the use of the web site and the materials contained therein. If you
choose to access our website from outside England and Wales you do so on your own initiative and you hereby
agree that in the event of a dispute between The Chesterfield Company and you the laws of England and Wales
will apply at all times.
1.10.5.8. Statutory Rights The above do not affect your statutory rights.
1.11. Data Protection
1.11.1 The Chesterfield Company takes privacy seriously. We process your personal data in accordance with the
Data Protection Act 1998 ('the Act').
1.12. Applicable Law
These Terms and Conditions of Trading are governed by and are to be construed in accordance with the laws of
England and Wales.
